ZhongYin Successfully Defends the Defendant in A Serious Duty-related Crime Case

Recently, a serious duty-related crime case handled under the supervision of CCDI, in which the team led by Wang Qiang, a partner of ZhongYin Law Firm represented the defendant, has been tried by the court of the second instance, who found that the procedures violated relevant legal provisions, and ruled that the case should be remanded for retrial.

The court of first instance held that our client Li, a leader of a central enterprise, misappropriated 66 million yuan of public funds and sentenced him to 14 years in prison; held that he misused his power and caused especially significant losses of more than 3.1 billion yuan of national interests and sentenced him to six years and six months in prison. Finally, the court sentenced him to 19 years in prison in total.

After taking the engagement for the second instance, the team of Wang Qiang met the defendant for several times, reviewed the files, carefully studied the case and after fully understood the facts, conducted a thorough argumentation, and thus believed that there were many problems in the first-instance trial of the case, such as unclear facts, insufficient evidence, and illegal procedures. In this process, the defense counsel communicated with the judge of second instance many times and submitted corresponding defensive arguments and evidence. After several extension of the trial period for collecting evidences, the court of second instance was finally convinced by the defense counsel and ruled that the case should be remanded.
