Professor Fan Chongyi: Interpretation of Revision to Criminal Procedure Law and Attorney's Defense

On the afternoon of November 20, 2018, the 15th “ZhongYin Lecture Hall” was held as scheduled. At the invitation of ZhongYin Law Firm, Professor Fan Chongyi, Honorary Dean of National Legal Aid Research Institute of China University of Political Science and Law, gave a lecture on the theme of “Interpretation of Revision to Criminal Procedure Law and Attorney's Defense”.

Professor Fan Chongyi has long engaged in teaching and research of procedural law and evidence law and is a well-known expert in the field of criminal procedure law in China. He has personally participated in each previous revision to China's criminal procedure law, made profound research achievements in criminal proceedings, litigation structures, procuratorial and supervisory system reforms and other areas, and made outstanding contributions to China's criminal justice reform for many years. In this lecture, Professor Fan Chongyi analyzed and interpreted the background and key contents of this Revision to the Criminal Procedure Law, explained, with profundity and an easy-to-understand approach, the connection between the supervision law and the criminal procedure law, the adjustment to the procuratorial function, the trial by default, the procedure for imposing lenient punishments on those confessing to crime and accepting punishment, the expedited procedure, and other major issues, and gave tips from a strategic height, on how defense attorneys play a role and look for arguments in these areas. Nearly 80 years old, Professor Fan easily completed the two-hour lecture. His profound knowledge, humor, openness, ambition in spite of old age, and righteousness brought round after round of applause on the site. By combining experience in handling cases, the participating attorneys had an enthusiastic interaction with Professor Fan. Many questions and confusions were solved under Professor Fan's inspiration.

In the end, Professor Fan Chongyi gave his sincere enlightenments and expressed his ardent hopes for the attorneys present. He said that attorneys should gradually go specialized through careful research on laws and cases, that they should contribute to the country's judicial undertaking by keeping in mind their mission as law practitioner, and that they should also develop their firm in more specialized and refined approach.
