“Hong Kong Litigation Forum” was successfully held in Zhong Yin Law Firm

On 2 March 2016, Zhong Yin Law Firm successfully held “Hong Kong Litigation Forum”, and invited lawyer Kwok Mao Lau from Zhong Yin’s Hong Kong partner firm LT LAWYERS as the guest speaker. Mr. Lau had a speech named <how to respond to the issues of fraud reports and have adequate compliance investigation with regard to Mainland companies listed in Hong Kong>. The director Mr. Ju Li, consultant Mr. Jinsheng Xu, and 50 other laywers from Zhong Yin Law Firm have participated the forum.
Director Mr. Ju Li summarized the progress of foreign related business in Zhong Yin and emphasized the significance of this forum to the development of Zhong Yin’s foreign related business and its planning of establishing a branch in Hong Kong.
Lawyer Lau outlined the Hong Kong litigation procedures and arbitration rules before the discussion. Main procedures of litigation include pleadings, exchange of primary evidence and witnesses’ statements, and trials. While arbitration rules have been separated into institutional arbitration rules and ad hoc arbitration rules. Litigation has established a relatively complete system whereas arbitration is more flexible.
Afterwards, Mr. Lau had a forum on five major issues: considering factors of responding actions after receiving reports; choosing the best assisting candidate for investigation carried out by audit committee; how to have independent investigation under the legal privilege protection; the corresponding duties of individual directors as to report matters; the obligation of disclosing secret information in part XIVA of secrecy provisions.
During the Q&A session, Mr. Lau gave answers to queries about privilege enjoyed by HK lawyers in legal practice, effectiveness of judgment and execution of rulings, stability of judgments, management and risk control of HK law firms, pre-litigation protection system in HK and the advantages brought by Zhong Yin-HK co-operations.
The forum had an active Q&A session followed by the perfect ending.
