ZhongYin Assists Gridmark in Protecting Dot Pattern Invention Patent and Winning an Award of 3M Damages
Recently, the IP team of ZhongYin (Shenzhen) Law Firm has received the Henan Higher People’s Court (2020) Yu IP Civil First No. 3 Civil Judgment, which means that with rigorous work attitude and extensive practice experience, the IP team of ZhongYin (Shenzhen) has successfully helped the Japanese-funded enterprise Gridmark Technology (SZ). Ltd. in protecting the dot pattern invention patent in suit. This first-instance technical intellectual property case is difficult to handle as it requires an analysis of complicated facts and a comparison of dot pattern information input and output technologies, so Henan Higher Court decided to try this case directly and upon trial, fully supported the plaintiff’s claim of 3 million damages.
Gridmark Technology (SZ). Ltd. (“Gridmark”) is a Sino-foreign joint venture innovative high-tech company with integrated and systematic solutions and software and hardware development capabilities in the field of dot pattern recognition. It is funded by YOSHIDA KENJI, who has won an invention award granted by the Ministry of Education, Culture, Sports, Science and Technology of Japan, and a national invention award granted by the Japan Invention Association, is committed to the research & development and promotion of intelligent education, writing and display technologies, and has more than 400 invention patents worldwide.
After accepting the entrustment, by upholding the spirit of diligence, responsibility, and excellence, the IP team of ZhongYin (Shenzhen) made detailed preparations and conducted systematic researches on the case through investigations & evidence collection, special surveys, internal discussions, mock trials, and the like, and especially a detailed comparison of the patent asserted by Gridmark and the technology embodied in the accused products. By doing so, the team not only fixed the evidence that the defendants committed the infringement, but also obtained necessary proof and illustration for calculating the damages. Finally, the team successfully convinced Henan Higher Court to award 3 million damages, protecting the legitimate rights and interests of the patent holder to the greatest extent.
